
Pursuant to a stipulated election agreement, a mail-ballot election was conducted in this matter. The ballots were mailed to voters on January 25, 2021, and the ballots were due back in the Regional Office by February 19, 2021.
The ballot count took place on February 23, 2021, with the parties participating by videoconference call. The tally of ballots showed that of the approximately 93 eligible voters, 31 cast ballots for Petitioner, 23 cast ballots for Intervenor, and zero cast ballots against representation. There was one challenged ballot and one void ballot. Challenges were not sufficient in number to affect the results of the election. Therefore, Petitioner received a majority of the valid votes counted.
The Intervenor timely filed five objections to the conduct affecting the results of the election. I have considered the Intervenor's objections and offer of proof. The Intervenor's objections do not raise any facts or arguments requiring that the election be set aside. Accordingly, I am overruling the objections and issuing a Certification of Representative.
