4/2/26 - The 100 plus Nuclear Security Officers & Alarm Station Operators
performing guard duties as defined in Section 9(B)(3) of the National Labor Relations
Act, working at Donald C. Cook Nuclear Plant voted to join our nuclear security Union, National Union of Nuclear Security Officers NUNSO a division of the United Federation LEOS-PBA Law Enforcement Officers Security & Police Benevolent Association. (UFLEOS-PBA)

From the onset Indiana Michigan Power Company started its Union-Busting campaign trying to persuade these Donald C. Cook nuclear security officers & alarm station monitors. In addition to the above, the employer started disciplining several employee's over sick leave usage just a few days before the actual vote. This decision to enforce this sick usage policy by Indiana Michigan Power Company actually backfired after our Union National Union of Nuclear Security Officers (NUNSO) wrote to the employer and demanded the employer:
1. Immediately cease and desist from enforcing this policy in a retroactive or coercive manner
2. Rescind all discipline issued under this policy
3. Refrain from any further actions that interfere with employees’ protected rights
Once Indiana Michigan Power Company received this email below, the company immediately rescinded its discipline against several employees and even apologized to everyone. With that being said the Donald C. Cook nuclear security officers & alarm station monitors were energized in knowing that the Union, NUNSO which at the time was not certified by the NLRB to represent these Donald C. Cook nuclear security officers & alarm station monitors was willing to fight for them regardless and was successful in having these writeups removed just prior to the vote. Now that is POWER!

RE: UNLAWFUL DISCIPLINE AND INTERFERENCE WITH PROTECTED RIGHTS
To Whom It May Concern:
The National Union of Nuclear Security Officers (NUNSO) has been made aware that management at the Donald C. Cook Nuclear Plant has recently announced and begun enforcing a disciplinary policy regarding employee sick leave usage.
Specifically, employees are being disciplined for exceeding six (6) sick days in a rolling twelve (12) month period, and such discipline is being applied retroactively.
This action is occurring during an active union organizing campaign and immediately prior to a scheduled representation election.
LEGAL CONCERNS
Your actions constitute unlawful conduct under the National Labor Relations Act, including but not limited to:
• Interference, restraint, and coercion of employees in violation of Section 8(a)(1)
• Discriminatory discipline intended to discourage union activity in violation of Section 8(a)(3)
• Unlawful implementation or change in enforcement of workplace policy during a union campaign
The timing, retroactive application, and disciplinary impact of this policy strongly indicate an attempt to influence employee free choice in the upcoming election.
DEMAND
NUNSO hereby demands that the Employer:
1. Immediately cease and desist from enforcing this policy in a retroactive or coercive manner
2. Rescind all discipline issued under this policy
3. Refrain from any further actions that interfere with employees’ protected rights
NOTICE:
Please be advised that NUNSO is prepared to pursue all available legal remedies, including filing unfair labor practice charges with the National Labor Relations Board.

5. UNIT AND ELIGIBLE VOTERS. The following unit is appropriate for the purposes
of collective bargaining within the meaning of Section 9(b) of the Act:
All full-time and regular part-time Nuclear Security Officers performing guard
duties as defined in Section 9(B)(3) of the National Labor Relations Act, working
for the Employer at its D.C. Cook Nuclear Power Plant located at 1 Cook Place,
Bridgman, Michigan; but excluding all office clerical employees, professional
employees and supervisors as defined by the Act.
OTHERS PERMITTED TO VOTE: The Parties have agreed that all full-time
and regular part-time Alarm Station Operators performing guard duties as defined
in Section 9(b)(3) of the National Labor Relations Act may vote in the election, but
their ballots will be challenged since their eligibility has not been resolved. No
decision has been made regarding whether the individuals in this classification are
included in, or excluded from, the bargaining unit. The eligibility or inclusion of
these individuals will be resolved, if necessary, following the election.
